Terms of Use

Thank you for visiting the AUREUS website and/or mobile application (the “Platform”).

Please read these Terms of Use carefully before using the Platform. The following Terms of Use govern your access to and use of the Platform operated by or for and on behalf of Interactive Aureus Fine Arts Training LLC and its affiliated companies (“Aureus”, “we”, “our”, or “us”).  By accessing or using the Platform, you agree to these Terms of Use. If you do not agree, please do not use or continue using the Platform.

1. Introduction

As a condition of using the Platform, you agree to these Terms of Use.

If you are under the age of 18 or otherwise lack legal capacity, you represent that your parent or legal guardian has reviewed and agreed to these Terms and our Privacy Policy on your behalf.
By accessing and clicking “I Agree”, you confirm that you have read, understood, and accepted these Terms of Use and the Privacy Policy, and that you assume full responsibility for your or your child’s use of the Platform.

Aureus may amend these Terms of Use at any time at its sole discretion. Updates will take effect once posted on our website or within the Aureus mobile application. You are responsible for reviewing the latest version regularly. Continued use of the Platform after any amendment constitutes your acceptance of the revised Terms.  

2. Account Details

If registration is required, you must provide accurate, complete, and current information. You may be asked to select a username and password, which must remain confidential. You must not disclose your login credentials to any third party or permit anyone else to use them.

Aureus may treat any use of your account credentials as your own authorised use. We reserve the right to disable any account or password if, in our reasonable opinion, you have failed to comply with these Terms.
If you believe your password has been compromised, you must:
1. Notify us immediately at contact@aureusacademy.com;
3. and Change your password without delay.

Aureus employs reasonable security measures, but we do not guarantee that the Platform is immune to all threats. You acknowledge that use of the Internet involves inherent risks.

The Platform may use cookies to enhance your browsing experience. You may adjust your browser settings to refuse cookies, but some features of the Platform may not function properly as a result.

3. Personal Data Protection

When you use the Platform, we may collect personal data and anonymous usage statistics.

Your personal data (such as name, contact number, and email) will be processed in accordance with the UAE Federal Decree-Law No. 45 of 2021 on Personal Data Protection (PDPL) and our Privacy Policy, which describes how we collect, use, disclose, and protect your information.

We may process your data for purposes including:
- Maintaining account security and user authentication;
- Providing and improving our services;
- Complying with UAE laws or lawful requests from government authorities.  

Any data you disclose in public areas of the Platform becomes public information. Exercise caution when doing so.

4. Intellectual Property Rights

All materials on the Platform—including information, design, graphics, audio, video, text, software, and other content (“Contents”) - are owned by, licensed to, or controlled by Aureus and its licensors.

You must not reproduce, modify, distribute, republish, or transmit any portion of the Contents without Aureus’s prior written consent.

No licence or right is granted by implication or otherwise to use Aureus’s trademarks, trade names, or logos without permission.

You must not attempt to reverse engineer, decompile, or derive the source code of the Platform. Any unauthorised use will result in immediate termination of your access.

5. Uploading Content

You are responsible for all content you post or transmit via the Platform.
You warrant that any submission complies with these Terms and applicable UAE laws and indemnify Aureus for any breach.

You agree not to upload or transmit content that:
- Is unlawful, defamatory, obscene, or offensive;
- Infringes any intellectual property or privacy rights;
- Contains advertising or spam;
- Introduces viruses or malicious code;
- or Could otherwise damage or disrupt the Platform.  

By submitting content, you grant Aureus a non-exclusive, worldwide, royalty-free, perpetual licence (with the right to sublicense) to use, reproduce, display, and distribute such content for the purposes of operating and promoting the Platform.  

Aureus may remove or restrict any content at its sole discretion and may disclose your identity to authorities or third parties if legally required or if such disclosure is necessary to protect Aureus’s rights.

6. Links to Third-Party Websites

The Platform may contain links to external websites not operated by Aureus. We are not responsible for their content, accuracy, or privacy practices.  

Your use of any third-party website is at your own risk.

7. Linking to Our Platform

Linking to or framing any part of the Platform is prohibited without Aureus’s prior written consent.
Aureus reserves the right to disable unauthorised links or frames and may require the removal of any link that misrepresents or damages Aureus’s reputation.

8. Disclaimer of Warranties

You acknowledge that your use of the Platform is at your sole risk.

The Platform and its Contents are provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied, including but not limited to merchantability, fitness for purpose, or non-infringement.  

Aureus does not warrant that:
- The Platform will be uninterrupted or error-free;
- Defects will be corrected;
- or The Platform or servers are free of viruses or harmful components.  

Any materials downloaded or obtained through the Platform are used at your discretion and risk. You are responsible for installing appropriate virus protection software.  

Nothing on the Platform constitutes legal, financial, or professional advice.

9. Limitation of Liability

To the maximum extent permitted by UAE law, Aureus shall not be liable for any direct, indirect, incidental, special, or consequential damages (including loss of data, profits, or goodwill) arising from your use or inability to use the Platform, even if Aureus has been advised of the possibility of such damages.

Your sole remedy for dissatisfaction with the Platform is to discontinue its use.

10. Indemnity

You agree to indemnify and hold Aureus, its affiliates, officers, employees, and agents harmless from any claims, damages, or expenses (including legal fees on a full indemnity basis) arising from your use of the Platform, breach of these Terms, or violation of any rights of another person or entity.

11. Governing Law

These Terms of Use shall be governed by and construed in accordance with the laws of the United Arab Emirates, as applied in the Emirate of Dubai.  Any dispute arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the Courts of the Emirate of Dubai.

12. No Waiver

Any delay or failure by Aureus to enforce any provision of these Terms shall not constitute a waiver of its rights.

13. Severability

If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.
